Terms of Use for Simple Baby Tracker

These Terms of Use (“Terms”) govern your access to and use of the Simple Baby Tracker mobile application and related services (collectively, the “Services”), operated by Simple Baby Tracker (“we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms and our Privacy Notice. If you do not agree, do not use the Services.

1. License to Use the Services

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use.

You may not:

Sell, rent, lease, sublicense, or commercially exploit the Services;
Reverse engineer, decompile, modify, or attempt to extract the source code of the app except where permitted by law;
Remove, alter, or obscure copyright, trademark, or proprietary notices;
Use automated systems, bots, scripts, or similar technologies to interfere with the operation of the Services;
Use the Services in any manner that violates applicable laws or regulations.

2. Local Data Storage

Simple Baby Tracker is designed to store your baby profiles, activity logs, notes, photos, milestones, and related information locally on your device and, when you opt in, sync securely to enable family sharing.

You are responsible for:

Maintaining access to your device;
Protecting your device from unauthorized access;
Creating backups if you wish to preserve your data.

Uninstalling the app, resetting your device, or clearing app data may permanently remove locally stored information.

Simple Baby Tracker offers optional family sharing that allows you to share baby data with caregivers.

If you choose to use this feature:

You may be required to sign in with your Google account;
Baby and family data may be synced to enable shared access;
You are responsible for maintaining access to your Google account;
We are not responsible for data loss resulting from changes to, suspension of, or loss of access to your Google account.

Google’s terms and policies apply to your use of Google Sign-In.

4. Purchases

Certain features of Simple Baby Tracker may require a one-time purchase.

Purchases are processed through Google Play Billing. Payment processing is handled by Google. We do not collect or store your payment card information.

Refunds, cancellations, and billing matters are subject to Google Play’s terms. You can restore a purchase on any device using the same Google account used for the original purchase.

5. Analytics

Simple Baby Tracker may use analytics services, including PostHog, to understand app usage, improve functionality, and enhance the user experience.

Analytics may include:

Feature usage
Screen views
App version information
Device and platform information
Performance and stability metrics

Analytics data is used to improve the Services and does not guarantee any particular results, recommendations, or outcomes.

6. Acceptable Use

You agree not to:

Violate any applicable laws or regulations;
Attempt to gain unauthorized access to the Services;
Interfere with the operation, security, or integrity of the Services;
Introduce malicious code, viruses, or harmful software;
Use the Services in a way that may harm other users or third parties;
Abuse subscription, backup, or analytics features.

We may restrict or terminate access to certain features if misuse is detected.

7. Intellectual Property

The Simple Baby Tracker application, including its software, design, branding, graphics, icons, text, and related materials, is owned by us or our licensors and is protected by applicable intellectual property laws.

These Terms do not grant you ownership of any intellectual property rights associated with the Services.

8. Disclaimers

The Services are provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we make no warranties regarding:

Availability or uptime of the Services;
Accuracy of analytics, insights, or recommendations;
Compatibility with all devices or operating systems;
Error-free or uninterrupted operation.

Features such as logging, timeline, and family sharing are provided for informational purposes only and should not be considered medical, legal, or professional advice. Always consult a healthcare professional for medical concerns regarding your baby.

9. Limitation of Liability

To the maximum extent permitted by law, Simple Baby Tracker shall not be liable for:

Loss of locally stored data;
Loss of sync or backup files;
Loss of access to third-party services such as Google Sign-In;
Decisions made based on app insights or recommendations;
Indirect, incidental, special, consequential, or punitive damages.

Our total liability arising from or relating to the Services shall not exceed the amount you paid to use the Services during the previous 12 months, or $50 USD, whichever is greater.

10. Termination

You may stop using the Services at any time.

We may suspend, restrict, or terminate access to certain features if:

These Terms are violated;
Abuse, fraud, or misuse is detected;
Required by law or third-party service providers.

Termination does not affect rights or obligations that arose prior to termination.

11. Changes to These Terms

We may update these Terms from time to time.

Updated Terms become effective upon posting within the app or through other appropriate notice.

Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of the Philippines, without regard to conflict of law principles.
